TORT LITIGATION

Tort Litigation in State and Federal Court is the Firm's principal speciality, including:

• Premises Liability, including slip and fall accidents, security related injuries and litigation concerning the design and operation of commercial and privately owned properties. The Firm has an extensive clientele of retail and grocery stores.

• Insurance Coverage and insurance related issues, including the interpretation of policy provisions and exclusions, declaratory judgment actions, defense of litigation under a reservation of rights, voiding for material misrepresentation, issues unique to excess and umbrella coverage, Florida PIP and UM/UIM coverage, the arbitration and trial of first party claims, as well as subrogation actions
• Trucking and Auto Liability representing trucking companies and insurance companies in all matters related to litigation arising out of injuries and loss.

• Building and Highway Construction, representing contractors and developers in construction defect litigation and personal injury litigation arising out of injuries related to the construction of highways, bridges and other structures.

• State and Municipal Liability, representing the State of Florida and several local municipalities, The School Board and other governmental units in a host of common law, tort and civil rights actions.

• General Liability, including defamation, malicious prosecution, wrongful repossession and other business torts and civil suits.

• Employment Liability, including claims related to sexual harassment, wrongful discharge, Americans with Disabilities and all aspects of claims related to Americans with Disabilities Act.

• Product Liability, representing a wide range of product manufacturers, distributors and retailers through corporate risk managers and insurance companies.

• Professional Malpractice, through the representation of physicians, hospitals, nursing homes and other providers of medical care, as well as corporate officers, directors, attorneys and engineers.

• Condominium Law, through the representation of condominium associations, officers, directors and developers, as well as unit owners in actions brought under the Florida Condominium Law, as well as general tort litigation.

• Mass Disaster/Multi-District Litigation, including an extensive history in asbestos litigation and hurricane disaster litigation, as well as all other areas of mass tort litigation.

• Guardianship and Probate Law, including the representation of minors in all claims.
